Tant el <strong> Tribunal Suprem com el <strong> Tribunal de Just\u00edcia de la Uni\u00f3 Europea s&#8217;han encarregat, en els \u00faltims anys, de recordar que, quan es tracta de consumidors, aquests han de rebre un tracte adient i amb tota l&#8217;informaci\u00f3.<\/strong><\/strong><\/strong><\/p>\n\t\t<\/div>\n\t\t\t<\/div>\n\n\t\n<\/div>\n\t\t<\/div>\n\t\t\t<\/div>\n\n\t\n<\/div>\n<h3 class=\"accordion_title\">\u00c9s possible efectuar la reclamaci\u00f3 de diferents conceptes<\/h3><div class=\"accordion\" rel=\"1\">\n<div class=\"accordion-item\"><a href=\"#\" class=\"accordion-title plain\"><button class=\"toggle\"><i class=\"icon-angle-down\"><\/i><\/button><span>LA CL\u00c0USULA S\u00d2L I DIFERENCIALS D'INTER\u00c8S ABUSIUS<\/span><\/a><div class=\"accordion-inner\">\n<p style=\"text-align: justify;\">La cl\u00e0usula s\u00f2l ha estat, sens dubte, una de les cl\u00e0usules abusives m\u00e9s utilitzades per les entitats. \u00bfL&#8217;objectiu? Assegurar per part de l&#8217;banc una remuneraci\u00f3 m\u00ednima en cas de baixada de tipus d&#8217;inter\u00e8s.<\/p>\n<p style=\"text-align: justify;\">En el cas de les cl\u00e0usules s\u00f2l, el banc <strong> limita el tipus d&#8217;inter\u00e8s, de manera que quan l&#8217;eur\u00edbor baixa (com actualment, que est\u00e0 en negatiu), l&#8217;inter\u00e8s de l&#8217;pr\u00e9stec no baixa (roman fix en el tipus &#8220;m\u00ednim&#8221; preestablert per l&#8217;entitat). L&#8217;entitat financera ven un pr\u00e9stec variable, quan en realitat es converteix, amb la baixada dels tipus d&#8217;inter\u00e8s, en un pr\u00e9stec fix, causant un greu perjudici a consumidor. Un perjudici que, d&#8217;haver estat ben informat i no haver primat pel banc seus propis interessos, no s&#8217;hagu\u00e9s donat. Per aix\u00f2, i en aquests casos, el consumidor pot reclamar <strong> la nul\u00b7litat de la cl\u00e0usula s\u00f2l, per falta d&#8217;informaci\u00f3 i falta de transpar\u00e8ncia banc\u00e0ria, aix\u00ed com el retorn de tot el que s&#8217;ha pagat de m\u00e9s per l&#8217;aplicaci\u00f3 de aquesta cl\u00e0usula s\u00f2l.\u00a0<br \/><\/strong><\/strong><\/p>\n<p style=\"text-align: justify;\">Molt unit a el concepte anterior, en els \u00faltims temps, ia causa de les baixes taxes de tipus d&#8217;inter\u00e8s Euribor (que hem dit, est\u00e0 en negatiu), s&#8217;est\u00e0 utilitzant una nova modalitat de &#8220;cl\u00e0usula s\u00f2l&#8221; per part de l&#8217;entitat, i que consisteix a <strong> establir un diferencial molt alt, per aix\u00ed assegurar-se una remuneraci\u00f3 en el pagament d&#8217;interessos de l&#8217;pr\u00e9stec a consumidor. Per tant, parlem d&#8217;una cl\u00e0usula s\u00f2l encoberta, ja que s&#8217;estableix un pr\u00e9stec variable referenciat a l&#8217;Euribor, per\u00f2 afegint sempre un diferencial tan alt que, en una situaci\u00f3 de lliure mercat, s&#8217;ha de considerar abusiva.<br \/><\/strong><\/p>\n<p style=\"text-align: justify;\">Per aix\u00f2, si tens un <strong> diferencial superior a 2 punts en la teva hipoteca, et recomanem que vagis a un especialista en dret bancari perqu\u00e8 pugui revisar el teu escriptura de pr\u00e9stec hipotecari i pugui determinar si tens un diferencial abusiu. Si \u00e9s aix\u00ed, podries reclamar la nul\u00b7litat de el diferencial (pel que el teu pr\u00e9stec quedaria referenciat a un tipus Euribor sense diferencial) i recuperar les quantitats abonades de m\u00e9s durant la vida de l&#8217;pr\u00e9stec amortitzat.<\/strong><\/p>\n<\/div><\/div>\n<div class=\"accordion-item\"><a href=\"#\" class=\"accordion-title plain\"><button class=\"toggle\"><i class=\"icon-angle-down\"><\/i><\/button><span>LES DESPESES HIPOTEC\u00c0RIES<\/span><\/a><div class=\"accordion-inner\">\n<p align=\"justify\">Actualment, ia causa de l&#8217;canvi legislatiu, tenim clar qui ha d&#8217;assumir les despeses de la hipoteca. No obstant aix\u00f2, qu\u00e8 passa amb les despeses hipotecaris abonats amb anterioritat a gener de 2019 en els pr\u00e9stecs hipotecaris? Doncs la resposta ens l&#8217;ha donada el mateix Tribunal Suprem en diverses sent\u00e8ncies, aix\u00ed com els jutges del nostre pa\u00eds.<\/p>\n<p>Les despeses de notaria, registre, gestoria i taxaci\u00f3 s\u00f3n les despeses que tradicionalment sempre ha pagat el consumidor, per\u00f2 que, gr\u00e0cies al criteri dels nostres tribunals dels \u00faltims anys, poden \u00e9sser reclamats.\u00a0<\/p>\n<p align=\"justify\"><strong> I quin termini de reclamaci\u00f3 de les despeses hi ha?\u00a0 <\/strong><\/p>\n<p align=\"justify\">La resposta \u00e9s clara i no ofereix dubtes des d&#8217;un punt de vista legal, tot i que sembla haver-se creat for\u00e7a confusi\u00f3 en aquest sentit: no existeix caducitat ni prescripci\u00f3 de l&#8217;acci\u00f3 de nul\u00b7litat. Tal i com ha dictat el nostre Tribunal Suprem, l&#8217;acci\u00f3 de nul\u00b7litat i declaraci\u00f3 d&#8217;abusivitat no t\u00e9 termini. Per tant, tot i que el teu pr\u00e9stec hipoetcari sigui de l&#8217;any 2000 o de 2018, es pot reclamar.\u00a0<\/p>\n<\/div><\/div>\n<div class=\"accordion-item\"><a href=\"#\" class=\"accordion-title plain\"><button class=\"toggle\"><i class=\"icon-angle-down\"><\/i><\/button><span>LAS TARGETES REVOLVING<\/span><\/a><div class=\"accordion-inner\">\n<p style=\"text-align: left;\">Les targetes revolving constitueixen un m\u00e8tode que utilitzen les entitats financeres per oferir liquidesa immediata als consumidors, a canvi d&#8217;un alt preu, que en moltes ocasions \u00e9s amagat pel banc: 1 <strong> inter\u00e8s abusiu i usurer.\u00a0<br \/><\/strong><\/p>\n<p style=\"text-align: left;\">Va ser el Suprem qui, a trav\u00e9s de la <strong> sent\u00e8ncia 628\/2015, de 25 de novembre, va fallar per primera vegada envers les anomenades targetes revolving, i va establir criteris per a determinar si els interessos de les targetes poden \u00e9sser considerats abusius.\u00a0<br \/><\/strong><\/p>\n<p style=\"text-align: left;\">M\u00e9s recentment el Tribunal Suprem, en una sent\u00e8ncia pionera del 4 de mar\u00e7 de 2020 va declarar la nul\u00b7litat d&#8217;un contracte de targeta revolving per tenir un inter\u00e8s molt elevat, al\u00b7legant que es tractava d&#8217;un inter\u00e8s totalment fora de mercat, i va fixar que qualsevol targeta amb un inter\u00e8s superior al 20% \u00e9s abusiva.<\/p>\n<p style=\"text-align: left;\">Per aix\u00f2, si has contractat una targeta revolving amb el teu banc que et cobra un inter\u00e8s de m\u00e9s d&#8217;un 20%, pots reclamar la seva nul\u00b7litat.<\/p>\n<\/div><\/div>\n<div class=\"accordion-item\"><a href=\"#\" class=\"accordion-title plain\"><button class=\"toggle\"><i class=\"icon-angle-down\"><\/i><\/button><span>CL\u00c0USULA DE REN\u00daNCIA A RECLAMAR<\/span><\/a><div class=\"accordion-inner\">\n<p style=\"text-align: left;\">La ren\u00fancia a exercitar accions legals de reclamaci\u00f3 judicial de cl\u00e0usules abusives \u00e9s tamb\u00e9 una pr\u00e0ctica habitual entre les entitats financeres.\u00a0<\/p>\n<p style=\"text-align: left;\">El <strong> Tribunal Suprem recentment, en la seva sent\u00e8ncia de data 49\/2021, de 4 de febrer,\u00a0 ha declarat l&#8217;abusivitat d&#8217;una cl\u00e0usula s\u00f2l i tamb\u00e9 d&#8217;un acord posterior en qu\u00e8 el deutor va signar una ren\u00fancia a exercir accions legals de reclamaci\u00f3.<\/strong><\/p>\n<p style=\"text-align: left;\">Si tens una cl\u00e0usula abusiva i, a m\u00e9s, l&#8217;entitat financera t&#8217;ha fet signar una ren\u00fancia a accions legals, vol dir que tens una doble cl\u00e0usula abusiva.
